What is the DMCA and Terms?
DMCA RulesThe following is a partial list of the rules with which Internet broadcasters must comply under portions of the Digital Millennium Copyright Act, 17 U.S.C. ß 114, given the nature of the licenses WCPR has obtained from the owners of the copyrights in sound recordings. We have abbreviated these rules to include only those that likely would be relevant given the manner in which you are able to use the WCPR Network system. The relevant rules which you must carefully review are as follows:
DMCA Take down Policy
It is WCPR policy to honor all take-down requests that comply with the notification requirements of the DMCA and other applicable intellectual property laws. Notification of Copyright Infringement
Please also note that under Section 512(f) of the Copyright Act, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. Don’t make false claims!
When the WCPR Network receives a DMCA take down notification of alleged copyright infringement, WCPR Network & removes the material that is the subject of the notification. If WCPR Network removes materials that you have uploaded WCPR will contact you about it. If you believe your content was removed as a result of mistake or miss-identification, you may submit a DMCA counter-notification that includes substantially all of the information listed below. (Please consult your legal counsel or see Section 512(g)(3) of the Copyright Act to confirm these requirements)

What happens if my broadcast is not compliant?
If your show is in non-compliance with the DMCA regulations, your show will be taken off-air and removed from WCPR directory. your listeners will not be able to access your show .You will need to bring your show back into compliance before your audience can access your show.
SENDING IN YOUR SHOW ON TIME.
The deadline to send your show is 48 hours preceding before it plays that week.
failure to do so twice within 3 months is grounds for termination from WCPR.
BASHING ANOTHER SHOW OR DJ ON THE WCPR NETWORK.
This out of Courtesy for all our talent is not allowed. Unless planed and sanction by WCPR.
- Continuous looped programs may not be less than three hours long. (live)
- Rebroadcasts of programs may be performed at scheduled times as follows: Programs of less than one-hour: no more than three times in a two-week period; Programs longer than one hour: no more than four times in any two-week period.
- You should only broadcast sound recordings that are authorized for performance in the United States.
- You should pass through (and not disable or remove) identification or technological protection information included in the sound recording (if any).
DMCA Take down Policy
It is WCPR policy to honor all take-down requests that comply with the notification requirements of the DMCA and other applicable intellectual property laws. Notification of Copyright Infringement
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner (“authorized person”) of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit WCPR to locate the material. Providing URLs in the body of your written communication is the best way to help us locate the content quickly.
- Information reasonably sufficient to permit WCPR to contact the authorized person, such as an address, telephone number, and, if available, an electronic mail address.
- A statement that the authorized person has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the authorized person is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
